This policy explains what personal data we process when you use constansengine.com, the Constans Console and the Constans Engine software, and why. We process data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).
1. What we collect
Account data. First and last name, company (optional), billing address (street, postcode, city, country), e-mail address, password (stored as a hash), language. We need the address for correct invoices. Purpose: providing your account and the Service. Legal basis: contract.
Payment data. Payments are processed by Stripe Payments Europe Ltd. (Ireland). We receive your billing name, address, the last four digits and brand of your card, and transaction status – never your full card number. Purpose: billing, tax compliance, fraud prevention. Legal basis: contract, legal obligation.
License and trading-account data. The trading account number(s) you register, broker server name, prop-firm profile selected, risk setting. Purpose: binding and verifying your license. Legal basis: contract. We never ask for or store your trading-account password.
Software telemetry. When Constans Engine runs on your terminal, it sends us status information so that the Console can display it: a periodic heartbeat, account balance and equity, open positions and pending orders placed by the software, closed trades executed by the software (instrument, direction, size, prices, times, result), software version and error messages. This data is linked to your license. Purpose: providing the Console, support, improving the software. Legal basis: contract; legitimate interest (service quality).
Usage data. Server logs (IP address, time, requested page, browser) at our hosting provider. In addition, our own cookie-free audience measurement: page requested, referring site (domain only), campaign parameters in the link (utm), device type (phone, tablet, computer) and browser language – no IP address, no cookies, nothing stored in your browser and no recognition across visits. When you register, we store in your account which link or site brought you to us. For signed-in members we also record whether a payment was started and whether the engine was downloaded. Purpose: security, stability, understanding how the website is used, improving the offer and the setup. Legal basis: legitimate interest.
Newsletter. Only if you explicitly switch it on at registration or in the settings: email address, first name, time of consent and a sending log. Unsubscribe any time via the link in every issue or in the settings. Sent via Resend Inc. Legal basis: consent.
Communication and help chat. E-mails and messages in the Console help chat that you send us, and our replies. Purpose: support, confirmations (e.g. cancellation). Legal basis: contract, legitimate interest.
Community (optional). If you create a community profile in the Console and make it visible, other signed-in members see your nickname, your short bio, your posts and key figures of your account (return, largest drawdown, number of accounts, length of membership, curve). Your name, e-mail address and account number are never shown. Visibility is off by default and can be switched off again at any time. We review reported posts and may hide them. Legal basis: consent.
Purchase consents. At purchase we store which declarations you agreed to (Terms, Risk Disclosure, automatic renewal, immediate start of the service), with the time and version of the texts – with us and as a note with our payment provider Stripe. Purpose: proof of the contract. Legal basis: contract, legal obligation, legitimate interest.
Cancellations and withdrawals without sign-in. If you use "Cancel contracts here" or "Withdraw from contract", we process the data you enter (name, e-mail address, contract details, time) and send you an acknowledgement of receipt. Purpose: carrying out and proving your declaration. Legal basis: contract, legal obligation.
Live display. While the Engine has a trade open, it reports balance, equity and the open position up to once per second so that the Console can show them live. Only data of accounts operated by us is shown publicly.
Refunds. If you request a refund, we store the request, the optional reason you give and its processing status. Legal basis: contract.
2. What we do not do
We do not sell personal data. We do not use your trading data for our own trading. We do not access your trading account – the software runs on your terminal and only sends information to us. Public performance figures on our website relate exclusively to accounts operated by us, never to customer accounts, unless a customer has expressly agreed to anonymised publication (e.g. as a beta participant).
3. Service providers (processors)
We use the following providers, each bound by a data-processing agreement:
| Provider | Purpose | Location |
|---|---|---|
| Stripe Payments Europe Ltd. | Payments, memberships, invoices | Ireland / USA |
| Supabase Inc. | Database, sign-in, Console data | Switzerland (Zurich data centre) / USA (support) |
| Cloudflare Inc. | Website and Console hosting, attack protection | globally distributed / USA |
| Infomaniak Network SA | E-mail mailbox [email protected] | Switzerland |
| Resend Inc. | Transactional e-mails, newsletter | USA |
| Hetzner Online GmbH | Servers for our own trading infrastructure | Germany |
Where data is transferred outside Switzerland or the EU/EEA, we rely on adequacy decisions or standard contractual clauses.
4. Retention
Account and license data: for the duration of the membership and 90 days thereafter, then deleted or anonymised. Telemetry and trade data: for the duration of the membership and 90 days thereafter, unless you ask us to delete it earlier. Billing records: 10 years (statutory retention). Server logs: 30 days.
5. Your rights
You can request access to, correction of, deletion of or a copy of your personal data, and object to or restrict processing, by e-mail to [email protected]. You can withdraw consent at any time. You may lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or, within the EU, your local supervisory authority.
6. Cookies
The website sets no analytics or marketing cookies. The only things stored for technical reasons are your Console sign-in (in browser storage) and, where applicable, security cookies of the hosting provider.
7. Security
Data is transmitted encrypted (TLS). Access to systems is restricted and logged. Passwords are stored hashed. The software authenticates to our servers with a license key, not with your trading credentials.
8. Changes
We may update this policy. The current version is always available at constansengine.com/en/legal/privacy/. Material changes will be announced in the Console or by e-mail.
